Terms of Service

1. Acceptance of Terms
By accessing or using Genos ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Genos is an AI-powered clinical intelligence platform designed for family therapists and mental health professionals. The Service provides tools for client management, session recording with AI transcription, AI-assisted clinical consultation, genogram creation, and practice analytics.
The Service is intended as a professional tool to assist licensed clinicians. It does not replace clinical judgment, and AI-generated insights should be reviewed by qualified professionals before use in clinical decision-making.
3. HIPAA and Protected Health Information
Genos is designed to comply with the Health Insurance Portability and Accountability Act (HIPAA) Security Rule and Privacy Rule. We implement administrative, physical, and technical safeguards to protect electronic protected health information (ePHI).
If you are a HIPAA-covered entity, you must execute a Business Associate Agreement (BAA) with Genos before entering any protected health information into the Service. Our BAA is available at genos.app/trust/baa. To execute the BAA, contact legal@genos.app.
4. AI Data Processing
Genos uses third-party AI services to power certain features. Session data may be processed by the Anthropic Claude API (for clinical analysis and consultation feedback) and the OpenAI Whisper API (for audio transcription). These services operate under data processing agreements and do not use your data for model training.
AI processing is ephemeral: data is sent to the API, processed, and the result is returned to Genos. No copies of your data are retained by these third-party services beyond the duration of the API call. All data is encrypted in transit using TLS 1.3.
5. User Responsibilities
As a user of the Service, you agree to:
- Maintain the security of your account credentials and not share them with unauthorized individuals.
- Ensure that all information you enter into the Service is accurate and that you have the necessary consents to store client information.
- Comply with all applicable laws, regulations, and professional licensing requirements, including HIPAA where applicable.
- Use the Service only for lawful purposes related to your clinical practice.
- Not attempt to reverse-engineer, decompile, or otherwise access the source code of the Service.
6. Limitation of Liability
To the maximum extent permitted by law, Genos and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Genos does not provide medical, legal, or clinical advice. AI-generated outputs are informational tools intended to support, not replace, professional clinical judgment. You are solely responsible for all clinical decisions made using information from the Service.
In no event shall our total liability exceed the amount you paid to Genos during the twelve (12) months preceding the claim.
7. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through the Service settings or by contacting support@genos.app.
Upon termination, you may request an export of your data in a standard, machine-readable format within thirty (30) days. After this period, your data will be securely deleted from our primary database and removed from backups in accordance with our retention schedule.
Genos reserves the right to suspend or terminate accounts that violate these Terms or engage in activity that compromises the security or integrity of the Service.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the version number and effective date at the top of this page. For material changes, we will notify you via email or through an in-app notification at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
